FanForged respects the intellectual property rights of copyright owners, trademark holders, creators, licensors, and brands. We expect all users of FanForged to do the same.
FanForged operates as a marketplace platform that allows third-party sellers to independently create, upload, market, and sell products and collectibles. Sellers are solely responsible for the content they upload and the products they list.
FanForged complies with applicable copyright laws, including the United States Digital Millennium Copyright Act (“DMCA”), and provides this Copyright Infringement Policy and Takedown Procedure for rights holders.
1. Marketplace Status
FanForged:
- Does not manufacture products
- Does not pre-screen all listings
- Does not independently verify intellectual property ownership claims
- Does not act as the publisher or creator of seller-generated content
All listings, images, descriptions, trademarks, logos, artwork, and products uploaded to the platform are the responsibility of the individual seller.
2. Reporting Copyright Infringement
If you believe that material on FanForged infringes your copyright, you may submit a DMCA Takedown Notice to FanForged's Designated Copyright Agent.
Notices must be submitted by:
- The copyright owner; or
- A person authorized to act on behalf of the copyright owner.
3. Required Elements of a Valid DMCA Notice
Your written notice must include ALL of the following:
A. Identification of the Copyrighted Work
Provide a detailed description of the copyrighted work claimed to have been infringed. Examples:
- Registered artwork
- Character illustrations
- Product photography
- Designs
- Written descriptions
- Logos
- Digital assets
Where possible, include registration numbers, official URLs, and links to original works.
B. Identification of the Allegedly Infringing Material
You must provide:
- Exact URL(s) of the listing(s)
- Seller name
- Product title(s)
- Screenshots where available
FanForged cannot process vague or incomplete complaints.
C. Your Contact Information
Include:
- Full legal name
- Company name (if applicable)
- Mailing address
- Phone number
- Email address
D. Good Faith Statement
You must include the following statement:
“I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.”
E. Accuracy and Authority Statement
You must include the following statement:
“I swear, under penalty of perjury, that the information contained in this notification is accurate and that I am the copyright owner or authorized to act on behalf of the copyright owner.”
F. Signature
A physical or electronic signature of the copyright owner or authorized representative is required. Typing your full legal name at the bottom of an email is accepted as an electronic signature.
4. Where to Send DMCA Notices

Upon receiving a compliant DMCA notice, FanForged may:
- Review the complaint for completeness
- Temporarily remove or disable access to the allegedly infringing content
- Notify the seller / account holder
- Provide the seller with a copy of the complaint
- Document the infringement claim internally
- Suspend repeat offenders where appropriate
FanForged reserves the right to:
- Remove content without prior notice
- Reject incomplete notices
- Request additional evidence
- Permanently terminate repeat infringers
6. Counter-Notification Procedure
If a seller believes material was removed in error or misidentification, the seller may submit a Counter-Notification.
Counter-notifications must include:

- Exact listing URL(s)
- Product title(s)
- Seller account information
B. Statement Under Penalty of Perjury
“I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled due to mistake or misidentification.”
C. Consent to Jurisdiction
“I consent to the jurisdiction of the Federal Court located in the jurisdiction where I reside, or if outside the United States, the jurisdiction in which FanForged operates, and I will accept service of process from the complainant.”

- Phone number
- Email address
E. Signature
Electronic or physical signature required.
7. Restoration Process
If FanForged receives a valid counter-notification, FanForged may:
- Forward the counter-notification to the original complainant
- Restore the removed content within 10–14 business days unless legal action is initiated by the complainant
FanForged is not obligated to restore any content.
8. Repeat Infringer Policy
FanForged maintains a strict repeat infringer policy. FanForged may suspend or permanently terminate users who:
- Receive multiple infringement complaints
- Repeatedly upload infringing material
- Attempt to evade enforcement actions
- Submit fraudulent counter-notifications
FanForged reserves sole discretion in determining repeat infringement status.
9. Trademark Complaints
Trademark complaints are handled separately from DMCA copyright claims. Trademark owners may submit complaints regarding:
- Unauthorized logo use
- Counterfeit merchandise
- Brand impersonation
- Misleading product listings
Trademark complaints should include:
- Trademark registration details
- Jurisdiction
- URLs of offending listings
- Evidence of infringement

10. False Claims & Misrepresentations
Important: Submitting knowingly false infringement notices or counter-notifications may expose the submitting party to legal liability, damages, attorney's fees, and account termination.
FanForged reserves the right to pursue action against fraudulent or abusive notices.
11. Platform Discretion
FanForged reserves the absolute right to:
- Remove any content
- Restrict visibility
- Suspend listings
- Freeze accounts
- Refuse reinstatement
- Cooperate with law enforcement or rights holders
Nothing in this policy limits FanForged's ability to take any action deemed necessary to protect the platform, users, or intellectual property rights.
12. Limitation of Liability
FanForged acts solely as an intermediary platform and shall not be liable for:
- User-uploaded content
- Intellectual property disputes
- Seller conduct
- Removal decisions
- Failure to remove content
- Restoration of listings
- Lost profits or business interruption arising from takedown actions
All users acknowledge that they upload and transact content at their own risk.
13. Copyright Compliance Recommendations for Sellers
Sellers are strongly advised to: use only content they own or are licensed to use, avoid unauthorized copyrighted artwork, avoid trademark misuse, and maintain documentation proving ownership or licensing rights.
Failure to comply may result in:
- Listing removal
- Account suspension
- Permanent bans
- Legal action by rights holders
