Terms of Service

1. Introduction

Welcome to Fanforged ("Fanforged," "we," "our," or "us"). Fanforged is an online marketplace platform that connects independent sellers and buyers of fan collectibles, memorabilia, merchandise, apparel, trading cards, toys, artwork, gaming products, and related fandom items inspired by entertainment franchises, sports, comics, film, television, anime, gaming, and pop culture.

By accessing or using Fanforged, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the platform.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or transact on Fanforged.

By using the platform, you represent and warrant that:

• You can legally enter binding agreements
• All information you provide is accurate and current
• You will comply with all applicable laws and regulations

3. Marketplace Role

Fanforged is a marketplace platform only. Fanforged does not:

• Manufacture products
• Own inventory listed by sellers
• Inspect products for legality, authenticity, or safety
• Guarantee the quality, legality, authenticity, or accuracy of listings
• Act as the buyer or seller in transactions

Transactions occur directly between buyers and sellers. Fanforged is not responsible for:

• Seller conduct
• Product defects
• Misrepresentations
• Shipping issues
• Counterfeit goods
• Intellectual property disputes
• Injuries, damages, or losses arising from products sold on the platform

4. User Accounts

Users are responsible for:

• Maintaining account security
• Keeping passwords confidential
• All activity conducted under their account

Fanforged may suspend or terminate accounts at any time, with or without notice, for violations of these Terms or any activity deemed harmful to the platform.

5. Seller Responsibilities

Sellers are solely responsible for:

• Their listings and product descriptions
• Pricing and shipping
• Taxes and compliance with laws
• Product authenticity and safety
• Customer service obligations

Sellers agree that listings must accurately describe products, counterfeit or illegal items are forbidden, they own or have the right to sell listed products, and they will honor completed sales.

Sellers assume all liability arising from product defects, injuries, intellectual property infringement claims, consumer protection violations, misleading advertising, and customs or import violations.

Fanforged reserves the right to remove listings or suspend sellers at its sole discretion.

6. Buyer Responsibilities

Buyers are responsible for:

• Reviewing listings carefully before purchase
• Understanding seller policies
• Verifying product compatibility, authenticity, and condition
• Paying all applicable taxes, customs duties, or import fees

Fanforged does not guarantee product authenticity, product condition, delivery timelines, or seller performance.

7. Payments

Payments are processed through third-party payment providers such as PayPal, Stripe, or other supported processors. Fanforged does not store full payment card information.

By using payment services, users agree to the terms and policies of the applicable payment processor. Fanforged may deduct marketplace fees, commissions, processing fees, refunds, chargebacks, or penalties from seller payouts.

8. Refunds and Disputes

Refunds, returns, and disputes are primarily handled between buyers and sellers. Buyer protection may be available through payment providers including PayPal Buyer Protection and credit card chargeback protections.

Fanforged may assist in dispute resolution but is under no obligation to intervene. Fanforged reserves the right to make final decisions regarding marketplace disputes, account limitations, or listing removals.

9. Prohibited Content and Conduct

Users may not:

• Sell counterfeit or illegal items
• Infringe copyrights, trademarks, or intellectual property
• Upload malicious code or harmful content
• Harass, abuse, or threaten others
• Manipulate reviews or transactions
• Circumvent marketplace fees
• Engage in fraud or deceptive conduct

Fanforged may investigate and remove content or accounts without notice.

10. Intellectual Property

All Fanforged branding, logos, site design, graphics, software, and content are owned by Fanforged or its licensors. Users may not copy, distribute, modify, or exploit Fanforged content without written permission.

Sellers retain ownership of their uploaded content but grant Fanforged a worldwide, royalty-free licence to display, market, reproduce, and distribute listings and associated media for marketplace operation and promotion.

11. Copyright and Trademark Complaints

Fanforged respects intellectual property rights. Rights holders may submit infringement notices by contacting:

Fanforged may remove listings or suspend accounts upon receiving complaints or suspected infringement claims.

12. Limitation of Liability

To the maximum extent permitted by law, Fanforged and its owners, employees, affiliates, partners, and licensors shall not be liable for indirect damages, lost profits, data loss, business interruption, personal injury, property damage, product defects, fraudulent listings, counterfeit items, or user conduct.

Fanforged's total liability shall not exceed the greater of the fees paid to Fanforged in the previous 12 months or AUD $100.

13. Indemnification

Users agree to indemnify and hold harmless Fanforged and its affiliates from any claims, liabilities, damages, losses, costs, and legal fees arising from user content, transactions, violations of law, intellectual property disputes, or breach of these Terms.

14. No Warranty

Fanforged is provided "AS IS" and "AS AVAILABLE." We make no warranties regarding platform availability, security, accuracy, reliability, product quality, seller conduct, or buyer conduct. Use of the platform is at your own risk.

15. Termination

Fanforged may suspend or terminate accounts or access at any time without liability. Users may stop using the platform at any time.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Queensland, Australia.

17. Changes to Terms

Fanforged may update these Terms at any time. Continued use of the platform after updates constitutes acceptance of revised Terms.
